1. Subject Matter of the Service
switchButler IoT (SBIOT) is a technical platform (devices, web portal, apps) for displaying data, events, alarms and notifications of compatible installations and — where enabled — for sending commands. The digital service is currently provided free of charge.
The service includes in particular: the remote display of statuses, measured values, events and alarms of compatible devices; functional notifications (push/e-mail); the execution of enabled remote commands (e.g. switching outputs); the management of installations, devices and permissions; the retrieval of the event history. The scope and availability of individual functions depend on the device model, the configuration and the permissions granted.
2. Intended Use and Prohibited Uses
SBIOT is a supporting monitoring and operating system for general civil and industrial applications.
The use of SBIOT devices, portal, apps and notifications is expressly prohibited:
- in medical applications, medical devices or life-support systems;
- in emergency-call, emergency or certified alarm systems (fire alarm, gas/smoke detection, certified intrusion alarm);
- in safety-relevant installations or functions (safety) whose failure may cause harm to persons or animals or significant property damage, including aviation and nuclear applications;
- for triggering, controlling or remotely operating weapons, explosive devices, explosives, pyrotechnic material or any device intended to injure, kill or destroy, or otherwise in violation of the legislation on war materiel and explosives;
- as the sole protective device of any installation.
Every installation must have independent, certified and standard-compliant safety devices (e.g. safety thermostats and safety pressure switches, safety valves, residual-current circuit breakers, approved fire protection systems). SBIOT replaces neither such devices nor the statutory inspection and maintenance obligations for installations.
3. Remote Monitoring: Purely Informative Character
The remote-control and remote-monitoring functions of SBIOT (including push notifications, e-mails, displays in the app and portal) are of a purely informative character. They do not constitute a recognised alarm channel or a safety device and do not replace them. The transmission of alarms with a safety function requires dedicated, certified and supervised systems (cf. SN EN 54-21, SN EN 50136 and the applicable Swiss VKF/AEAI fire protection directives). The delivery of notifications depends on mobile networks, operating systems, phone settings and third-party providers and is not guaranteed.
This principle reflects the state of the art of the official Swiss standards: the directives of the Swiss Federal Office for Buildings and Logistics on building automation standards (BBL, Bau 210d, edition 01.04.2025; German original — no official English translation exists) provide that safety alarms must be reported by the respective dedicated system — not via the building automation system — that safety-relevant installations must be operable locally, and that all safety functions must be ensured in hardware, independently of the automation system. Remote monitoring is an operating and monitoring instrument, not a safety device of the installation.
4. Account and Acceptance
Registration requires truthful information and verification of the e-mail address. In the client app, acceptance of the Privacy Policy and these Terms takes place through an explicit action and is logged with document version, date and time. Portal accounts issued or administered by an authorised organisation are subject to these Terms from first use. The user is responsible for safeguarding their access credentials and for the use of their own account.
5. Permitted Use
The service must be used lawfully and in accordance with the intended use of the installations and devices. The following are prohibited: unauthorised access, alteration of data, circumvention of security measures, disruption of the platform, and reverse engineering, except to the extent permitted by mandatory law.
The SBIOT platform is authoritative for the identity, assignment, status and permissions of the devices. Devices may only be operated by authorised persons; the transfer of a device or an installation to third parties takes place exclusively through the procedures provided for this purpose on the platform. A factory reset of a device does not cancel its registration and assignment on the platform. Remote commands are logged with the originator (account or role), date and time; whoever triggers a command bears the responsibility for the effects of that command on the installation.
6. Availability
The service depends on internet connections, servers, mobile networks, third-party services and the availability of installations and devices. We guarantee neither uninterrupted availability nor freedom from errors nor the delivery of every notification.
7. Suspension and Discontinuation of the Service
The digital service is free of charge. Elbro may modify, suspend or discontinue it in whole or in part at any time, subject to a notice period of 30 days via app, portal or e-mail. Immediate suspension or discontinuation remains reserved in the event of security reasons, misuse, legal obligations or force majeure. In the event of discontinuation, the user may request the release of their own data before deactivation.
8. Updates
Elbro assumes no obligation to provide updates, new functions, future compatibility or the continuation of the platform, apps or firmware, subject to mandatory statutory provisions. Published updates may change or remove functions.
9. Warranty and Liability
The free digital service is provided "as is". To the extent permitted by law, Elbro excludes any liability for indirect and consequential damages, interruptions, delays, undelivered notifications, the unavailability of third parties and the improper use of the service. Liability for wilful misconduct and gross negligence (art. 100 of the Swiss Code of Obligations (CO)), liability for auxiliary persons within the scope of art. 101 CO and mandatory product liability under the Swiss Product Liability Act (PLA) as well as any other liability that cannot be waived by law remain reserved. The statutory warranty for purchased hardware is governed by the respective purchase contract.
Use contrary to the intended use (section 2) is at the sole risk of the user and releases Elbro — within the limits of the law — from any liability; any contractual warranty lapses.
10. Changes to These Terms
Elbro may amend these Terms. Material changes are communicated appropriately before they take effect. Where required, renewed versioned acceptance is requested before the service can continue to be used.
11. Applicable Law and Place of Jurisdiction
Swiss law applies. The place of jurisdiction is the registered office of Elbro AG (Niederhasli ZH). Mandatory places of jurisdiction remain reserved, in particular the place of jurisdiction at the consumer's place of residence (art. 32 of the Swiss Civil Procedure Code (CPC)) as well as mandatory provisions of the state of habitual residence of consumers in the EU.
12. Severability
The invalidity of individual provisions does not affect the validity of the remaining provisions.
13. Language Versions
These Terms are published in German, French, Italian and English. In case of discrepancies, the German version shall prevail.
