Supplementary Terms for Installers and Administrators (B2B)

These Terms supplement the switchButler IoT (SBIOT) Terms of Use for professional users (installers, administrators of installations for third parties, resellers). Provider: Elbro AG, Gewerbestrasse 14, 8155 Niederhasli (ZH), Switzerland, UID CHE-107.927.973.

1. Scope

They apply to the use of the web portal with administrative roles, of the provisioning app and of the functions for managing installations and devices on behalf of end customers. They apply whenever those professional functions are used under an administrative role or through the provisioning app.

2. Obligations of Installers/Administrators

The installer/administrator undertakes:

  • to install and configure devices professionally and in compliance with the applicable regulations (in particular the Swiss Low-Voltage Installation Ordinance/Standard (NIV/NIN) for electrical installations, with the required authorisations);
  • to inform the end customer about the intended use, the prohibited uses and the purely informative character of remote monitoring (sections 2 and 3 of the Terms of Use), and to ensure that the installation has the required independent safety devices;
  • to use administrative rights only for installations for which the customer's authorisation has been given, to protect the access credentials and to treat customer data confidentially;
  • not to use the platform for safety purposes and not to offer it as such.

3. Roles and Data

Unless otherwise agreed in writing, Elbro and the installer/administrator are each responsible for the personal data processing under their own control. The installer/administrator remains responsible for the end-customer relationship (installation contract, permissions and support). If personal data are processed on behalf of the other party, the required data-processing agreement must be concluded separately. Sensitive administrative actions are logged with the actor, role, action, target, time and result, where available (audit log).

3a. Confidentiality and Security Incidents

The installer/administrator shall treat end customers' access credentials, configurations and data confidentially and use them exclusively for the performance of the contract. Detected security incidents relating to the platform (compromised access credentials, unauthorised access, loss of a device with administrative access) must be reported to Elbro without delay.

The service is provided without any assurance of availability or response times; there are no service level agreements (cf. Terms of Use, sections 6-8).

4. Liability and Indemnification

The installer/administrator shall indemnify Elbro against third-party claims arising from non-professional installation, use contrary to the intended use, failure to inform the end customer or breach of these Terms. In all other respects, the limitations of liability of the Terms of Use (section 9) apply.

5. End of the Professional Relationship

Upon termination of the relationship, the administrative access rights must be revoked. Installation data remain assigned to the end customer's installation or account, subject to the Privacy Policy and applicable retention obligations. Copies of access credentials and customer data held locally by the installer/administrator must be deleted after termination, unless a statutory retention obligation exists.

6. Language Versions

These Terms are published in German, French, Italian and English. In case of discrepancies, the German version shall prevail.
